As a result of operative-searching and investigative activities carried out, representatives of Investigation Service of the Ministry of Finance of Georgia imposed criminal liability on three employees of Department of Health and Social Services of Tbilisi City Hall on the fact of neglect of official duty and on two heads of one of the companies on the fact of misappropriation of large amount of state-owned money by the group of people, with a prior agreement.
Investigation determined that, the accused persons took part and won a tender announced by the City Hall of Tbilisi Municipality, referring the purchase of resort (mountain resort) services for children and youngsters with disabilities. In order to receive illegal income, heads of the above mentioned company, inserted fake data in the documents proving the actual service carried out. As if 600 persons were provided with resort services with total value of GEL 179 000, while part of those people mentioned in the documents did not receive services at all and the other part received services partially.
By means of the above mentioned criminal activities, heads of the company illegally received GEL 34 775 belonged to the City Hall of Tbilisi Municipality.
Investigation determined that employees of Department of Health and Social Services of Tbilisi City Hall were obliged to maintain control and supervision on above mentioned activities stemmed out of the tender. They improperly fulfilled their official duties as they didn’t check real number of users foreseen by tender on resort services, didn’t study documentation on provided services as presented by the company. Thus, there were obvious signs of forgery – artificially expanded number of users and volume of services provided - foreseen by tender. Above mentioned activities caused significant violation of legal interest of the State.
Investigation is underway under the second and third parts of Article 180 and the first part of Article 342 of the Criminal Code of Georgia, which envisages imprisonment from 6 to 9 years.
