On October 3 of the current year, on the basis of a court ruling, representatives of Investigation Service of the Ministry of Finance of Georgia arrested heads of one of the construction-developer company G.J. and T.J. on the fact of committing of the offense (fraud, fraudulent possession of another’s property in large amounts by illegal use of the official position) defined by the third part of Article 180 of the Criminal Code of Georgia.
We would like to underline, that on the basis of application from the future owners of the construction-developer company, on May 29, 2018 investigation was initiated on the fact of misappropriation of large amounts of money by the abovementioned company, paid by citizens to purchase residential apartments.
Evidences obtained by the investigative activities confirm, that the accused G.J. and T.J., were intentionally using their official positions to deliberately take possession on the large amounts of money belonging to the citizens. For this purpose, construction-development company announced the commencement of large-scale housing construction projects at the beginning of 2016, so that the company did not have proper permits for construction. In order to attract large amounts of money, active advertising campaigns, including social networks, were conducted for attraction of local and foreign residents interested in purchasing a flat.
Investigation revealed, that only on one object, the accused G.J. and T.J. fraudulently took possession on money belonging to the future owners equaled to GEL 3,356,385.
Over 5,000 investigative activities were conducted during the investigation. Among them, more than 2,000 people and the persons involved in the case throughout the country were interviewed.
The accounting and legal documentation of those organizations connected to the construction-development company were seized and thematic examinations and revisions were appointed. At the same time, for the purpose to establish the cost of the works that were actually fulfilled, the engineering-technical expertise was appointed on the objects being under construction in Tbilisi and Batumi respectively.
At this stage, investigative activities are actively pursued for detection of all possible criminal acts committed by the abovementioned companies during the construction of residential buildings and other persons involved in the offense.
Based on the relevant evidence, all future owners of the flats to be constructed by the construction-development company, who resulted financial loss due to the company’s criminal activities, will be recognized as victims.
