THE FACT OF MISAPPROPRIATION OF STATE OWNED LAND PLOTS

As a result of operative-searching and investigative activities carried out, representatives of Investigation Service of the Ministry of Finance of Georgia, exposed two facts of misappropriation of large quantity of state owned property by means of manufacturing and using of the forged official documents. Criminal liability was imposed on eight persons, two of which were detained as initiators of the above mentioned criminal activities.

Investigation determined that, the accused persons, in order to deceitfully obtain ownership of the state property, manufactured forged documents confirming the fact, as if they legally owned land plots, and used them together with statements signed by so called “false witnesses”. Based on the above mentioned forged documents, in one case, the accused person requested registration of the state owned 2 265 m2 agricultural land plot in village Mskhaldidi, district of Mtskheta, with total value equaling GEL 37 877. As for the second case, the accused person registered ownership of 6500 m2 land plot located in village Saguramo, district of Mtskheta, with total value equaling GEL 133 965.

During the investigation process, land plots are distrained. After completing corresponding legal procedures, those land plots will be returned to the state.

Investigation is underway under the third part of article 180 and first part of article 362 of the Criminal Code of Georgia, which envisage imprisonment from 6 to 9 years.
